Evidence for Dummies

Most people treat Evidence like a vocabulary test. It is actually a logic game you are currently losing because you still use the dictionary definition of relevance.

About this course

Most bar takers think they know Evidence because they have watched enough legal dramas to feel confident. They scream objection in their heads and wonder why their practice scores are in the basement. The bar exam does not care if a statement feels like hearsay. It cares if the statement meets three specific elements that you likely skimmed over in your 1L year. You are not failing because you are not smart. You are failing because you are playing by the wrong rules. This course stops the guessing. We are going to treat the Federal Rules of Evidence like a reality TV elimination. If a piece of evidence does not have a VIP pass or a specific exception, it is out. You will learn to use the MIMIC rule for character evidence, identify the actual boundaries of hearsay exceptions, and apply the policy exclusions that exist because society made a deal with itself. We prioritize the mechanics of the law over the theory of it. By the end, you will stop arguing about what is fair and start arguing about what is admissible. You will have a decision tree for every document and witness the examiners throw at you. This is the difference between hoping for a passing score and knowing you have already earned it. You will walk into the exam room with the calm of someone who already knows the answers.
